<br /> <br /> <br />WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES <br />September 27, 2010 <br /> <br />The Washington Township Board of Zoning Appeals met in regular session on September 27, <br />2010 in the Conference Room of Washington Township Development Services. Members of the <br />Board present were Mr. Horine, Mrs. Fish, Mr. McDaniel, Mr. Roberts and Mrs. Mulligan. Mr. <br />Schwartz was excused. <br /> <br />Call to order at 7:00 p.m. <br /> <br />Mr. Horine explained the hearing format and voting procedure. <br />The Oath was administered by Mr. Horine. <br />Case #A-1616: Douglas Westendorf , 5161 Durwood Road <br /> request under Article 2, Section <br />3E, for a variance from Article 7, Section 5B of the Washington Township Zoning Resolution to <br /> of an accessory structure, a twenty foot by twenty <br />perty located in a residential (R-4) zoning district. <br />Jim Wahl, Zoning Manager, presented the case. <br />Mr. Horine- The property photo is showing a 10 foot utility easement and the applicant is <br />proposing to build 5 feet over the utility easement. I see that as a problem since there is no <br />building allowed in easements. <br />Mr. Wahl- I am not aware of a problem with this setback. The applicant may have more <br />information on the specifics of the easement. <br />Mr. Roberts- Why the building be moved 10 feet away from the property line? <br />Douglas Westendorf, 5161 Durwood Road, - My main interest here <br />neighborhood. I believe that the proposed placement will make the shed less visible from the <br />street and also eliminate cutting down trees. With regard to the easement, my understanding is <br />that I can secure permission from the utility company to place the shed in the easement. I am in <br />the process of making that request the construction in the easement I will <br />need a 5 foot setback variance. I have permission from Vectren already. I have also talked to <br />Time Warner Cable, SBC and DP&L. If I moved it 10 feet forward, it will be closer to my house <br />and more visible from the street. The existing trees and bushes will hide the shed if allowed at <br />3 <br /> <br /> <br />
