<br />WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES <br /> November 11, 2013 <br />The Washington Township Board of Zoning Appeals met in regular session on November 11, <br />2013 in the Meeting Room of Washington Township Government Center. Members of the Board <br />present were Mr. Horine, Mrs. Mulligan, Mr. Schmidt, Mr. Roberts and Mr. Schwartz. Mr. <br />McDaniel was excused.Call to order at 7:00 p.m. <br />Pledge Allegiance. <br />Mr. Schwartz, Chairman, explained the hearing format and voting procedure. <br />The Oath was administered by Mr. Schwartz to all persons planning to testify. <br />Case # A-1680 MidWestern requests a variance to permit automobile sales and lease use <br />located at 20 Marco Lane <br />Zoning Manager, Ryan Lee, presented the case. <br />The applicant is requesting a use variance to permit an auto leasing and sales use within a B-2 <br />zoning district. The B-2 district does not permit auto sales and leasing. These uses are <br />principally permitted within the B-4 zoning district alongside other predominantly outdoor sales <br />and storage business and retail uses. <br />The Township Zoning Resolution states that the Board of Zoning Appeals shall have the power <br />to authorize use variances to allow uses not otherwise permitted whereby owing to special <br />conditions, a literal enforcement of the resolution will result in unnecessary hardship, so that the <br />spirit of the resolution shall be observed and substantial justice done. In this case, the applicant <br />is stating that the interior car sales and leasing land use is in line with the developed character of <br />Marco Lane. <br />Staff does not take issue with the proposed use of the building. Given the proposed use is to be <br />conducted wholly indoors the land use will function in the manner in which the property is <br />currently zoned. Staff recommends approval of the use variance with the following modification: <br />1.The sales and leasing of automobiles shall be conducted within a completely enclosed <br />building. The outdoor display of automobile(s) for commercial purposes is prohibited. <br />2.The land use variance does not include servicing of automobiles. <br />Brian Van Nest, 9444 Tahoe Drive, Centerville, Ohio, he has been sworn in. <br />1 <br /> <br />
