WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES
August 26, 2013

The Washington Township Board of Zoning Appeals met in regular session on August 26, 2013
in the Meeting Room of Washington Township Government Center. Members of the Board
present were Mr. Horine, Mrs. Mulligan, Mr. McDaniel, Mr. Schmidt and Mr. Roberts. Mr.
Schwartz was excused. Call to order at 7:00 p.m.

Pledge Allegiance.

Mr. McDaniel, Chairman, explained the hearing format and voting procedure.
The Oath was administered by Mr. McDaniel to all persons planning to testify.
Case # A-1673 John D. Mott request a variance for accessory structure setback of side yard
located at 29 Louelm Avenue

Zoning Manager, Ryan Lee, presented the case.

The applicant is requesting a variance for the reduction of side yard setback for an accessory
structure in the rear yard than would otherwise be permitted by the Zoning Resolution standards.
The side yard setback for accessory structures in the front half of the rear yard is 15 feet from the
property line within an R-4 zoning district; consistent with the setback provision for the principle
structure on the lot. This is done to provide setbacks consistent with the residential homes for the
portion of the rear yards within close proximity to neighboring lots.
The proposed variance request will encroach into the required side yard setback by 5 feet, leaving
the proposed structure setback 10 feet from the side lot line. The rear yard of 29 Louelm has a
substantial incline sloping upward toward the rear lot line.
The physical limitations of the rear yard slope and proximity to the driveway affect the reasonable
placement of the structure conforming to Township standards. The applicant is showing that due
consideration to the aesthetics and site improvements have been considered through matching
existing building materials and style as well as yard drainage. The neighboring property owner has
also submitted a letter for consideration supporting the requested variance. Staff recommends
approval of the variance as requested.
Mr. McDaniel asked if the letter of support from the neighboring property was the neighbor with
the fence line in the photo. Mr. Lee confirmed that it was the neighbor in support of the accessory
structure.
1
