<br /> <br />WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES <br /> August 26, 2013 <br /> <br />The Washington Township Board of Zoning Appeals met in regular session on August 26, 2013 <br />in the Meeting Room of Washington Township Government Center. Members of the Board <br />present were Mr. Horine, Mrs. Mulligan, Mr. McDaniel, Mr. Schmidt and Mr. Roberts. Mr. <br />Schwartz was excused. Call to order at 7:00 p.m. <br /> <br />Pledge Allegiance. <br /> <br />Mr. McDaniel, Chairman, explained the hearing format and voting procedure. <br />The Oath was administered by Mr. McDaniel to all persons planning to testify. <br />Case # A-1673 John D. Mott request a variance for accessory structure setback of side yard <br />located at 29 Louelm Avenue <br /> <br />Zoning Manager, Ryan Lee, presented the case. <br /> <br />The applicant is requesting a variance for the reduction of side yard setback for an accessory <br />structure in the rear yard than would otherwise be permitted by the Zoning Resolution standards. <br />The side yard setback for accessory structures in the front half of the rear yard is 15 feet from the <br />property line within an R-4 zoning district; consistent with the setback provision for the principle <br />structure on the lot. This is done to provide setbacks consistent with the residential homes for the <br />portion of the rear yards within close proximity to neighboring lots. <br />The proposed variance request will encroach into the required side yard setback by 5 feet, leaving <br />the proposed structure setback 10 feet from the side lot line. The rear yard of 29 Louelm has a <br />substantial incline sloping upward toward the rear lot line. <br />The physical limitations of the rear yard slope and proximity to the driveway affect the reasonable <br />placement of the structure conforming to Township standards. The applicant is showing that due <br />consideration to the aesthetics and site improvements have been considered through matching <br />existing building materials and style as well as yard drainage. The neighboring property owner has <br />also submitted a letter for consideration supporting the requested variance. Staff recommends <br />approval of the variance as requested. <br />Mr. McDaniel asked if the letter of support from the neighboring property was the neighbor with <br />the fence line in the photo. Mr. Lee confirmed that it was the neighbor in support of the accessory <br />structure. <br />1 <br /> <br /> <br />
