<br /> <br />WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES <br /> February 25, 2013 <br /> <br /> <br />The Washington Township Board of Zoning Appeals met in regular session on February 25, <br />2013 in the Meeting Room of Washington Township Government Center. Members of the Board <br />present were Mr. McDaniel, Mr. Schwartz, Mr. Horine and Mr. Roberts and Mrs. Mulligan. Call <br />to order at 7:00 p.m. <br /> <br />Pledge Allegiance. <br /> <br />Mr. Schwartz explained the hearing format and voting procedure. <br />The Oath was administered by Mr. Schwartz to all persons planning to testify. <br />Mrs. Mulligan has recused herself from this case due to conflict of interest. <br />Case # A-1666 Donald and Kathleen Collins requests a variance for reduction of sideyard <br />setback for an accessory structure located at 5539 Folkestone Drive. <br /> <br />Zoning Manager, Ryan Lee, presented the case. <br /> <br />The applicant is requesting a variance for the reduction of side yard setback for an accessory <br />structure in the rear yard than would otherwise be permitted by the Zoning Resolution standards. <br />The side yard setback for accessory structures in the front half of the rear yard is 40 feet from the <br />property line within an R-1 zoning district. <br />The proposed variance request will encroach into the side yard setback by 25 feet, leaving the <br />proposed 80 square foot structure setback 15 feet from the side lot line. The rear yard has a <br />sizeable incline which begins to slope upward directly behind the existing rear yard deck and <br />walkway area. <br />The applicant is disabled with limited mobility and would like to locate the storage shed on the <br />same elevation as his residence. The physical limitations including the grading of land and <br />natural elements which would otherwise affect the reasonable placement of the structure <br />conforming to Township standards does exist on the site given the homeowner’s difficulties with <br />mobility. Staff has identified that a practical difficulty exists on the property which precludes the <br />adherence to the Zoning Resolution for the current request.
